If there is an accident where both drivers are ticketed, who is considered at fault?

I was involved in an accident where both parties were ticketed. I turned left at a yellow light and the other guy plowed on straight ahead through his yellow light. He does not want to file a claim on his car which is scratched but has also been totaled in a previous accident. I got a good dent on the front of my car, but I'm curious as to what would happen if I filed a claim. Would his insurance be affected if we were both ticketed? We have the same insurance company.

With both of you being ticketed after the accident there is a chance that you are both considered at fault by the insurance company. The at fault party would likely see an increase in their rate due to the accident, but if you are both considered 50% at fault in the accident then you would both likely experience a rate increase. Unfortunately, there is no way to tell what the insurance company is going to decide until you file a claim. I would recommend getting an estimate for repairs to your vehicle and then you can make a more educated decision.
