Can an excluded driver claim bodily injury if they're at fault?

I was hit by an excluded driver. They're at fault no doubt but they put in the claim first. What can I do against that driver?

I would file a claim on their insurance. Excluded drivers are exempt from coverage. You may want to contact your own insurance too in the meantime to let them know about the situation and get assistance on next steps. If the claim is denied and your insurance won't help, I would look into legal assistance to file a suit against the at-fault party.
