Can I file a claim against the driver if I was in the car?

I was injured while my daughter was driving. She was at fault, do I file a claim against her, she is on our insurance?

Since your daughter was at fault, your insurance will not pay for your injuries under your bodily injury liability coverage. That coverage will only cover the passengers of the other vehicle. Pennsylvania requires all drivers to carry First Party Medical Benefit up $5,000 – this is the coverage you will need to file under. Keep in mind the claim will not only go against your daughter but can also be included on the policyholders claim history.
