Question

Can I still file an injury claim separate from a vehicle damage claim?

I was in an accident which was not my fault. My car was a total loss for which I received payment for from the other motorist's insurance. However, I also suffered a hernia in the accident. I got treated a few months later and now want to file a claim for that because I wanted to wait until after I got treated so they didn't have to wait for total costs after treatment. Arizona has a two-year statute of limitations, but I just want to make sure that applies for claims filed separately.

You are correct. Some injuries may take a while to become apparent. If you are still within the statute of limitations — and the injury was a direct result of the accident — you can reopen the claim to receive payment.
