Can an insurance company refuse payment for an accident claim by their client if I'm unable to pay their full set amount?

I'm on short term disability. I have intentions to pay the full amount of the claim for their client (I was uninsured at the time) but I can't pay as much down, including the monthly payment plan they are asking for. Can they refuse my offer? The lady was downright rude and told me to "figure it out."

The full amount of damages is to be settled at the time of loss. The insurer giving you a payment option versus taking you to court is already a courtesy they are offering you. You cannot "negotiate" how much you will pay for damages, especially as the uninsured at-fault party.

I would still pay them what you can to hopefully avoid any further action against you.
