Question

Can an insured driver use their insurance to cover an uninsured vehicle after an accident?

My car isn’t insured. My girlfriend, who has insurance, got into an accident driving my vehicle. Can she use her insurance to cover my vehicle?

No. Car insurance follows the vehicle, not the driver. In this case, you don’t have much recourse. The only time her insurance would cover it is to work as secondary liability coverage – with your coverage being primary. In this case, I’m afraid to say you are out of luck. I recommend contacting a lawyer if you’ve damaged another person’s property and are worried about being sued.
