Can a police officer tow my car if I had a temporary pass from my insurance company?
I had a temporary pass from my insurance company to drive to get a smog check and back to their office, but my car was towed by the police.
I'm not really sure what they gave you was a temporary pass — a vehicle is either insured or it is not. Temporary insurance doesn't really exist.
You should definitely go back to your insurer and verify if you were insured at the time of the towing or not. If it was not insured, the police can tow your car and issue a citation. If it was insured, then you need to dispute the matter in court that the officer unlawfully took your vehicle.
I will add if an insurance agent claimed it was fine to leave — even temporarily — without a finalized policy in place, then they were not doing what was in your best interest.
If you have any questions, don't hesitate to ask.
