Who is considered at fault in a parking lot crash?

On may 26, 2017 I was backing out of a parking lot and was hit by another driver. I always check before I back out, but this time there was a car in the parking lot that was speeding through even though the speed limit is 5-10mph. Neither of us have any dents or cracks or anything like that; only a few scratches. We discussed paying for each other's damage, but I feel like I shouldn't have to pay anything since he hit me.

Since it was a parking lot incident, fault can be difficult to determine. If you two aren't able to come to an agreement on the repairs, your best bet would be to just contact your insurance company and let them know about the what happened. This will remove you from having to negotiate with the other driver about the repairs. Given the fact that your vehicle was in reverse at the time of the crash, you might actually be considered at fault even if the other driver was speeding. The determination of fault will ultimately be up to your and the other driver's insurance company.
