DUI ticket issued vs convicted on insurance application

Question of "have you received a ticket for DUI" on insurance application. No trial after almost 2 years - how to answer? Florida resident. 25 year old Male. Received a ticket in NC for DUI in NOV 2016. Has a lawyer that is confident the ticket will be thrown out when case goes to court. Case keeps getting continued and he needs to get insurance for car now. Applications ask: "have you received a ticket for DUI", yes he has received a ticket, but not a conviction. The court system in NC could keep this case going for years. What are his options in answering this question on the applications?

It depends how it is marked on his MVR. If it is still an open case and no conviction has been issued you can answer no because during the reporting process it will not show. Just note that if he signs up on a plan and then is convicted of the DUI and the ticket shows up then the current insurance plan may increase in rates, or the company may even cancel the plan at some point if he is no longer eligible. If you talk directly to an agent they should be able to advise you on what the best process is with their company.
