I'm not an adjuster so I'm not able to tell you who is at fault. With that being said, most of the time, the person who initially caused the accident would be responsible for the damage to both vehicles. Since you do not have insurance, there can be consequences to driving and being involved in an accident without insurance. Here is some information regarding driving without insurance in California. Usually, you can be ticketed and even have your license suspended. I would follow up with the department of motor vehicles. As far as the damages, you will need to contact the insurance company of the driver that hit you. Here is some information on what to expect when filing a claim. Good luck and if you have any other questions, don't hesitate to ask.
