Question

I agreed to pay out of pocket for an accident, but do I have to pay for their rental car if it's prohibitively expensive?

I was in an accident a month ago and we both agreed not to involve insurance. I agreed to pay for a rental and the fix. I paid for the fix, but the car rental that she had was crazy expensive and I don’t feel like paying for it. She threatened to still call her insurance if I don't.

Sorry to hear about your accident. If you accepted fault for the accident you are responsible for the person's transportation expenses. However, if they abused that agreement, it can be disputed. If they got transportation nicer what they were originally driving--as in renting a luxury car when they could have gotten a more economical rental--then I would get insurance or a mediator involved.

Personal disputes such as this are the exact reason that going through an insurance company can be a good idea. One thing to note is that if you paid to fix the damages they cannot file a claim and get a separate payout as that is considered fraud.

Thanks and have a great day.
