Do I have to tell my insurance agent about a claim?

Our new car in our driveway was smashed by a driver who takes full responsibility and has great insurance. Should we involve our agent too?
They already reported it and their insurance called us saying their client takes full responsibility. They are sending out their adjuster to see how much damage — our car was hauled to a nearby car place. Their insurance told us to have a landscaper estimate damage to our yard and wall and fax them the invoice so that they can send us the money for it. We have a 1000 deductible on our car and on our property. Our agent said we do not have to file a claim with them and pay our 2000 in deductibles—just let the other insurance agency handle it all. Is this ok? Also, if they say our car is not totaled {the policemen said they would never drive our car by looking at the extensive damage}—- can we sue?
