Can my neighbor's insurance cover my smoke damage?

My neighbor's building caught fire and my property has smoke damage as a result. But right now I don't have homeowners insurance. Is there any way the neighbor's insurance would cover the damage to my building?

Unfortunately, not having homeowners insurance in this situation puts you in a tough spot, but there are still a couple of things worth looking into.

If your neighbor's fire was caused by negligence, their homeowners insurance liability coverage could potentially pay for damage to your property. Liability coverage is designed to cover situations where a policyholder is legally responsible for damage to someone else's property. That said, proving negligence is the key hurdle here. If the fire was accidental with no clear fault, their insurer may not have an obligation to pay your claim.

The first step is to find out if your neighbor actually has homeowners insurance and, if so, to file a third-party claim directly with their insurance company. Document everything you can right now: photos of the damage, any repair estimates, and a record of communication with your neighbor. That documentation will matter regardless of how this plays out.

Because you don't have insurance of your own, you won't have a policy to fall back on if the neighbor's insurer denies the claim. That's really the hardest part of this situation. It would be worth talking to your neighbor directly and, if needed, consulting with a professional who can help you understand your options from a legal standpoint.

I highly suggest shopping around for your own home insurance policy as soon as you can. Not having coverage on your own property leaves you at risk for major financial setbacks. If you've got a mortgage on the property, you are likely required to have coverage, too.
