Question

What do I do if a tree falls on my car?

My car was parked at my apartment complex and a rotted tree fell on my car. I spoke with a Travelers agent and he told me that the complex is liable for my damage since they knew the tree was rotted and never cut it down. The problem is that it has been 4 months since it happened and they still have not fixed my car. What can I do?

If you have comprehensive coverage then there should be no issue filing a comprehensive claim with Travelers and getting your vehicle repaired. Your insurance company would also handle any issues with your apartment complex being liable for the damage. When you reach out to Travelers you should speak with their claims department specifically and they should be able to help you out.

Your insurance should cover the damages minus your deductible. In this case, you would file a comprehensive claim for the damage. It depends on how the policy was reinstated. If they reinstated with no lapse, then you are free to file a claim.
