This varies depending on your state and on your insurance company. If you're currently married and living in the same household, many insurance companies will require you to be covered by the same policy. However, if you're married and currently living in separate households, you will likely be required to carry separate policies because your cars will be garaged in different locations (which will affect the amount you each pay).

In addition to your insurance company's policies, you will also need to contend with state laws. Most states, including Texas, allow you to exclude household members from your car insurance policy. For those interested, the nine states that prohibit exclusions are: Hawaii, Kansas, Minnesota, New York, North Carolina, Rhode Island, Vermont, Virginia and Washington.

Before your insurance company will allow you to exclude your spouse, they may also require that you demonstrate that your spouse does have other coverage. It is also important to note that legally and ethically, your spouse needs to be aware that they are being excluded from the policy.
