Question

Who is responsible for a tree falling onto a garage?

We had a big windstorm last week. My neighbor’s tree came down and landed right on my garage roof.

I have homeowners insurance through Grange, but I’m not sure whose insurance is supposed to handle this. Since it was their tree, does their policy pay? Or does my homeowners insurance cover the damage first?

I don’t want to start a conflict with the neighbor if this is something insurance normally handles.

When a neighbor’s tree falls on your house, the answer surprises a lot of homeowners: your homeowners insurance usually pays first, not your neighbor’s.

In most situations, insurance follows the property that was damaged. So if a storm knocks a tree onto your garage roof in Green Bay, your Grange homeowners policy would typically cover the repairs under your dwelling coverage. That can include damage to the roof, structure, and sometimes debris removal.

Your neighbor’s insurance usually only comes into play if they were negligent. For example, if the tree was clearly dead, diseased, or leaning dangerously and the neighbor ignored warnings to remove it, their liability coverage might apply. In that case, their insurer could potentially pay for the damage.

But when a healthy tree falls during a windstorm or other natural event, insurance companies typically consider it an “act of nature.” That means each homeowner’s policy handles damage to their own property.

There are a couple of other details that may affect the claim:

  • Your deductible, which applies before insurance pays
  • Coverage for other structures, if a detached garage or fence was damaged
  • Debris removal limits, since tree removal can be expensive

The good news is that situations like this are extremely common, especially after major storms. Insurance companies deal with them regularly and the process is usually straightforward once the claim is filed.

If you’re unsure how your policy applies, it’s worth calling your agent and asking how tree damage claims are handled under your specific coverage. Understanding those details now can make future storm situations much less stressful.

In a state of emergency, does my insurance company have to help me if I have flood damage but no flood insurance?

If your home and basement were damaged by water that wasn't attributed to an actual flood then you will likely be covered by your company.
