What happens if the repo guy damaged my car?

I was two months late on my car payment due to surgery. The bank sent the repo guy who tried to tow my car but it slipped and was damaged. The bank refused any responsibility. They also refuse to give me the repo company contacts. Now my insurance wants to pay out but someone has to be held responsible for the damage.
