Question

Can another driver file a claim on my insurance if they were hit by someone else driving my vehicle?

My boyfriend hit another vehicle while he was driving my car, but it was unclear which driver was at fault. The other driver took my insurance information, but my boyfriend isn't on my policy. Could they still file a claim against my company even though I wasn't driving?

Since insurance coverage follows your vehicle then your policy would pay primary for damage caused by your car even if someone else was driving. That being said, it is possible that through the details of the accident the other driver could very well be considered at fault, in which case, the other driver's insurance policy should cover the damage to your car. I would recommend contacting your insurance company first and let them know what happened. They should be able to guide you forward from this point.

Removing a claim from my insurance record

I would recommend getting what's called a CLUE Report. This is a comprehensive loss report. It would show your entire loss history with your name. Show this to your insurance company to prove you did not have an accident. This should remove the claim you are being rated for. Best of luck.
