Question

Can I file a claim if my insurance policy is canceled but was active at the time of an accident?

Just before leaving the country for post-graduate school work, I was hit by an uninsured driver. My insurance policy was active when the accident happened, but I didn't have time to file a claim and repair my vehicle before my trip abroad. I am now back in the country and my insurance is no longer active on the vehicle. Can I still file a claim for repairs?

It will depend on how long ago the accident happened. You can use our chart on time limits for filing claims by state and see if you still have time to file a claim. If the accident happened in Florida, you have 4 years from the date of the incident to file a claim, based on the chart. The timeframe varies by state so look carefully. If you are still within the time limit and your policy was active at the time of the incident, contact the company you were with to see if you can pursue a claim.

Sorry to hear about your situation. From what I can gather, it appears that she hit the rear of your car while you were waiting at the gate of your apartment complex. If this is true, it's going to be quite difficult for her to make the case that you backed into her. That said, with no witness…

How do I get a false claim on my record removed?

The best course of action would be to call that insurance company and request all paperwork associated with that claim. It should show as a zero dollar payout, which you could show to other companies to dispute the claim. If you want to fight it off your record, you'd need to look up your CLUE…

Can a lender dictate what my deductible is?

Unfortunately, the terms of your loan can dictate what your coverage deductibles must be. If I'm hit my a driver with the same insurance company as mine, do I file the claim under my policy or the other driver's?

Filing the claim on your policy means you are going to have to pay your collision deductible and could possibly impact your rate. Personally, I would not agree to do that. The majority of rear-end collisions are considered to be the fault of the driver in the back, so it should not take them any lo…
