Question

Can I file a claim if my insurance policy is canceled but was active at the time of an accident?

Just before leaving the country for post-graduate school work, I was hit by an uninsured driver. My insurance policy was active when the accident happened, but I didn't have time to file a claim and repair my vehicle before my trip abroad. I am now back in the country and my insurance is no longer active on the vehicle. Can I still file a claim for repairs?

It will depend on how long ago the accident happened. You can use our chart on time limits for filing claims by state and see if you still have time to file a claim. If the accident happened in Florida, you have 4 years from the date of the incident to file a claim, based on the chart. The timeframe varies by state so look carefully. If you are still within the time limit and your policy was active at the time of the incident, contact the company you were with to see if you can pursue a claim.

How do I get a false claim off my insurance report?

For uninsured motorist claims, it's likely that your insurer would want a police report of the incident. What I don't know is if it would be possible to still get a police report and redo the claim. If they make you pay the higher deductible at the end of this, make sure they mark the cla…
