Question

Can I file a claim if my insurance policy is canceled but was active at the time of an accident?

Just before leaving the country for post-graduate school work, I was hit by an uninsured driver. My insurance policy was active when the accident happened, but I didn't have time to file a claim and repair my vehicle before my trip abroad. I am now back in the country and my insurance is no longer active on the vehicle. Can I still file a claim for repairs?

You may still file a claim if your policy was active at the time of the accident

It will depend on how long ago the accident happened. You can use our chart on time limits for filing claims by state and see if you still have time to file a claim. If the accident happened in Florida, you have 4 years from the date of the incident to file a claim, based on the chart. The timeframe varies by state so look carefully. If you are still within the time limit and your policy was active at the time of the incident, contact the company you were with to see if you can pursue a claim.

It is illegal to pay for someone else's car insurance

While it is not illegal to pay for someone else's policy, you might run into issues if she's on your policy as well. Car insurance is regulated at the state level and priced at the zip code level. So, if she's on your car insurance policy but not living at your residence, you will probably run into…

Can Esurance deny a refund if I forgot to cancel my policy when I switched to a new company?

This sounds like an company issue and not a state law. Insurance companies in Illinois are legally required to issue refunds for "unearned premium", but you didn't prepay your bill. Long story short, they only have to repay the portion of your premium that extends past the cancellation date; i.e. y…
